These Terms of Use ("Terms") govern your access to and use of Hello Hungry Meals's mobile application "Hello Hungry Meals" for meal orders. By accessing or using the App, you agree to be bound by these Terms.

1. Use of the App:

a. You must be at least 18 years old to use the App. By using the App, you represent that you are at least 18 years of age.

b. You agree to use the App solely for ordering meals for personal consumption and not for any illegal or unauthorized purpose.

c. You agree not to interfere with the operation of the App or to disrupt its functionality.

2. Account Registration:

a. In order to use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

b. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

c. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

3. Ordering and Payments:

a. When placing meal orders through the App, you agree to provide accurate and up-to-date information, including delivery address and payment details.

b. You authorize us to charge your provided payment method for the total amount of your order, including any applicable taxes, fees, and delivery charges.

c. All payments made through the App are final and non-refundable, except as provided in our Refund Policy.

4. Intellectual Property:

a. All content, logos, trademarks, and other intellectual property displayed on the App are owned by Hello Hungry Meals or its licensors and are protected by copyright, trademark, and other laws.

b. You agree not to reproduce, modify, distribute, or create derivative works based on the content of the App without our prior written consent.

5. Privacy:

a. Your use of the App is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the App, you consent to the terms of our Privacy Policy.

6. Disclaimer of Warranties:

a. The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.

b. Hello Hungry Meals does not warrant that the App will be uninterrupted or error-free, or that any defects in the App will be corrected.

7. Limitation of Liability:

a. In no event shall Hello Hungry Meals or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

b. Our total liability for any claims arising out of or relating to these Terms or the App shall not exceed the total amount paid by you to us in the preceding six months.

8. Governing Law and Dispute Resolution:

a. These Terms shall be governed by and construed in accordance with the laws of Florida, United States of America, without regard to its conflict of law principles.

b. Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively by arbitration conducted in accordance with the rules of State of Florida, with a single arbitrator appointed by mutual agreement of the parties.

9. Changes to the Terms:

We reserve the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the App.
